General Terms and Conditions

Article 1 - Definition and interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

“Company” (also referred to as either "We", "Us" or "Our" in this website policies) refers to THOT IT Solutions, located 2, Rue Jean Fischbach, Leudelange L-3372, Luxembourg;

“Cookies” means small files that are placed on your computer, mobile device or any other device by a webSite, containing details of your browsing history on that webSite among its many uses;

“Etiquette in technology” refers to an unofficial code of policies that encourage good behavior on the Internet which is used to regulate respect and polite behavior on social media platforms, online chatting Sites, web forums, and other online engagement websites;

“Personal Data” is any information that relates to an identified or identifiable individual;

“Publisher” refers to THOT IT Solutions as the company that uploads, creates, or edits content on this website. THOT IT Solutions is the one who maintains and manages this website;

"User" is any natural person accessing the Site, on their own behalf or on behalf of a legal person, whether they are a simple visitor, or have already provided Data concerning them in their quality of customer or prospect ;

“Web Host” (also referred as “Host”) is the entity providing web services for another, such as an Internet Service Provider, a systems integrator, a reseller, a technical consultant, an application service provider, or similar entity;

“Website” (also referred to as either “Site” or “Platform”) refers to THOT IT Solutions, accessible from https://www.thot-it.com.

Article 3 - Access to the Site

The Publisher endeavors to allow access to the Site 24 hours a day, 7 days a week, except in the event of force majeure or an event beyond the control of the Publisher, and subject to possible breakdowns and interventions of maintenance necessary for the proper functioning of the Site and services.

Therefore, the Publisher cannot guarantee availability of the Site and/or services, reliability of transmissions and performance in terms of response time or quality. No technical assistance is provided for the User, whether by electronic means or telephone.

Access to the Site and its use are reserved for strictly personal use. You agree not to use this Site and the information or data contained therein for commercial, political, advertising purposes and for any form of commercial solicitation and in particular the sending of unsolicited e-mails.

Article 4 - Content of the Site and intellectual property

If the Publisher were to be the subject of an amicable settlement or a legal procedure because of your use of the Site, it may sue you to obtain compensation for all damages, sums, convictions and costs that may arise from this procedure.

These provisions are not intended to circumvent legal requirements, or to exclude liability in cases where it cannot be excluded under the law, but to inform the User of certain non-guaranteed risks.

The website https://www.thot-it.com may contain hypertext links to other Sites on the Internet. Links to these other resources make you leave the Site https://www.thot-it.com .

It is possible to create a link to the presentation page of this Site without the express authorization of the Publisher. No prior authorization or request for information may be required by the Publisher with regard to a Site wishing to establish a link to the Publisher's Site. However, this Site should be displayed in a new browser window. However, the Publisher reserves the right to request the removal of a link that it considers to be inconsistent with the purpose of the Site https://www.thot-it.com .

 

Article 8 - Personal data

The Site provides the User with the collection and processing of personal information with respect for privacy, in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) as well as any additional rules applicable to personal data in Luxembourg.

Article 9 - Cookies

The Site may automatically collect standard information. Any information collected indirectly will only be used to track the volume, type and pattern of the traffic using this Site. This enables us to develop its design and layout and for other administrative and planning purposes and more generally to improve the service we provide to you.

Article 10 - Photographs and representation of products

Any photographs of products accompanying their description are not contractual and do not bind the Publisher.

Article 11 - Applicable law

This website and its policies are governed by Luxembourg law, regardless of the place of their use. In the event of any dispute, and after the failure of any attempt to find an amicable solution, the Luxembourg courts will have sole jurisdiction to hear this dispute.
